Terms of Service
By downloading, accessing, or using the App, you agree to these Terms of Service. If you do not agree, do not use the App.
1. Purpose
America's Weather provides weather forecasts, radar and satellite imagery, lightning data, tropical information, Insights, observations, maps, and related meteorological products for informational purposes only. Weather forecasting is inherently uncertain.
2. No guarantee of accuracy
WE DO NOT WARRANT OR GUARANTEE THAT ANY INFORMATION PROVIDED BY THE APP IS ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE. Forecasts, observations, radar, lightning, tropical products, and other weather content are estimates based on available data and analysis.
3. Not official emergency advice
The App does not replace official warnings or emergency management. Always monitor the National Weather Service, National Hurricane Center, and local emergency officials for decisions involving personal safety, evacuations, severe weather, flooding, hurricanes, lightning, aviation, marine activities, outdoor events, or travel.
4. Use at your own risk
You assume all responsibility and risk for using information from America's Weather. Do not rely on this App as your sole source for life, safety, health, property, business, or financial decisions.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, America's Weather, its owners, employees, contractors, affiliates, licensors, and data providers shall not be liable for damages arising from inaccurate or delayed forecasts, missed severe weather, incorrect imagery or lightning data, tropical forecast errors, software errors, outages, interruptions, data delays or corruption, or service unavailability — including personal injury, death, property damage, business interruption, lost profits, crop losses, travel or evacuation expenses, or consequential, indirect, or incidental damages. YOUR USE OF THE APPLICATION IS ENTIRELY AT YOUR OWN RISK.
6. Maximum liability
If we are found liable for any claim, our total liability shall not exceed the amount you paid for the subscription during the previous twelve (12) months, or $100, whichever is greater.
7. Data sources
Weather information may come from governmental and third-party providers (including NWS, NOAA, NHC, NBM, GOES, MRMS, SPC, WPC, CPC, and others). We are not responsible for errors, delays, outages, or inaccuracies originating from those providers. Government products are not owned by America's Weather; we own our software, UI, and Insights content.
8. Weather Insights
Insights contain professional meteorological opinions based on information available when written. They may change without notice, are not guarantees, and represent judgment rather than certainty.
9. Availability
We do not guarantee uninterrupted service. The App may be unavailable due to maintenance, outages, data interruptions, updates, or circumstances beyond our control.
10. Subscriptions, trials & refunds
Certain features require a paid Pro subscription, offered as monthly or annual auto-renewing subscriptions. A seven-day free trial is available; eligibility for an introductory offer through the App Store is determined by Apple. Payment is charged to your Apple or Google account when you confirm the purchase. Subscriptions renew automatically at the then-current price unless cancelled at least 24 hours before the end of the current period, and renewal is charged within 24 hours before the period ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
America's Weather does not issue refunds. Purchases made through the Apple App Store or Google Play are billed by those stores; any refund request must be made to Apple or Google under their policies. We do not guarantee that a store will grant a refund. Website or other direct purchases, when offered, are non-refundable except where a refund or cancellation right is required by applicable law.
Manage or cancel mobile subscriptions in your Apple or Google account; restore purchases where required by the platform.
11. Features may change or be removed
We may add, change, suspend, limit, or remove features of the App at any time, including features offered to Pro subscribers (maps, overlays, data sources, Insights, Game Day, route tools, and other paid capabilities). A subscription or trial does not guarantee that any particular feature will remain available in its current form, or at all.
Feature changes, limitations, or removals are not, by themselves, grounds for a refund from America's Weather. Store refund policies still apply to App Store and Google Play purchases.
12. Intellectual property
Software, graphics, written discussions, logos, trademarks, and proprietary content are owned by America's Weather unless otherwise indicated. You may not reproduce, redistribute, scrape, reverse engineer, or commercially exploit App content without written permission.
13. Acceptable use
You may not abuse the service, attempt unauthorized access, interfere with other users, or use automated means to harvest forecasts, radar, alerts, or other data in bulk.
14. Termination
We may suspend or terminate access for violations of these Terms.
15. Governing law
These Terms are governed by the laws of the State of Texas without regard to conflict-of-law rules. Legal actions shall be brought in the courts located in Harris County, Texas.
16. Changes
These Terms may be updated periodically. Continued use after changes constitutes acceptance of the revised Terms. Material updates may also be highlighted in-app.
Weather disclaimer
Weather is inherently unpredictable. Never rely solely on this application for severe weather, flooding, hurricanes, lightning, aviation, boating, outdoor events, travel, emergency response, or public safety. Always monitor official NWS and local emergency warnings. By using America's Weather, you acknowledge forecast uncertainty and accept the associated risks.
